Terms of Service

These Terms of Service govern your use of Marketel Inspect, Marketel's booking engine, Front Desk mobile app, and related software ("the Service"). By using the Service, you agree to these terms. The additional plain-language Inspect terms apply when you use Inspect.

1. The Service

Marketel provides condition-report tools for property operators and direct-booking/front-desk tools for independent accommodation properties. We store reports you save, host booking pages, process guest reservation requests, and provide management tools accessible through the applicable authorized account. Inspect and booking access and subscriptions are separate. In the United States iOS storefront, Inspect may open Stripe-hosted web billing; other storefronts do not show those links.

2. Subscription & Billing

• Eligible properties may start one 14-day full-access trial. A valid payment method is required, but the amount due when the trial begins is $0.
• Before you start the trial, Marketel shows the plan you selected, its renewal price, and the date of the first charge. Unless canceled before that date, the monthly plan bills $149 per month and the annual plan bills $1,490 per year.
• Trial eligibility is limited to one trial per property. A previously trialed or paid property may be asked to pay immediately when reactivating.
• You can cancel from Marketel's web billing settings or by contacting support.
• If you cancel during the trial, access continues until the trial end shown at checkout and no subscription charge is made. After billing begins, cancellation takes effect at the end of the current billing period.
• Subscription payments and partial billing periods are non-refundable except where required by law.
• Each Inspect account includes one lifetime finalized report without a card. The separate paid Inspect plan is $29 per month for one operator and 30 finalized reports per billing period, unless a different offer is clearly shown before checkout. It renews monthly until canceled.
• Finalizing an Inspect report consumes the applicable allowance. Deleting it does not restore allowance, and unused monthly allowance does not roll over.
• We reserve the right to change pricing with 30 days notice.

3. Your Responsibilities

• You are responsible for the accuracy of your property information, room or unit details, rates, and availability.
• You are responsible for fulfilling reservations made through your booking engine.
• You must keep your Front Desk PIN secure.
• You must not use the Service for illegal purposes.
• You are responsible for permission to enter and photograph a property and for reviewing the facts in each Inspect report, including optional AI wording suggestions.

4. Guest Payments

Guest card verification uses a temporary $1 authorization hold processed by Stripe. It is not payment for the stay. Unless a disclosed no-show policy permits the $1 to be captured, the authorization is released or allowed to expire. You collect payment for the stay directly from guests at check-in.

5. Availability & Uptime

We aim for 99.9% uptime but do not guarantee it. We are not liable for lost bookings due to downtime, technical issues, or third-party service failures (Stripe, hosting providers, etc.).

6. Content & Data

• You retain ownership of your property content (photos, descriptions, rates).
• You grant us a license to display this content on your booking engine.
• You grant us the limited rights needed to store, process, export, and share the Inspect content you submit at your direction.
• Guest data (names, emails, phone numbers) is shared with you for reservation fulfillment.
• We may use anonymized, aggregated data for analytics and product improvement.

7. Termination

We may terminate your account if you violate these terms, engage in fraudulent activity, or fail to pay. A property owner may request booking-account deletion from the iOS app or through support. Booking-account deletion has a 7-day grace period before operational data is deleted. An Inspect operator may separately delete the Inspect account and reports immediately from its account screen. We may retain limited records where required by law or necessary to resolve disputes and prevent fraud.

8. Notifications

Front Desk notifications help you respond to bookings and availability issues, but delivery is not guaranteed. Device settings, connectivity, Apple Push Notification service, or other circumstances may delay or prevent an alert. You remain responsible for maintaining accurate availability and fulfilling accepted reservations.

9. Limitation of Liability

Inspect organizes user-provided observations and is not a professional inspection, safety assessment, code review, authenticity service, or legal certification. Marketel is not liable for indirect, incidental, or consequential damages. Our total liability is limited to the amount you paid us in the 3 months preceding the claim.

10. Changes to Terms

We may update these terms. We'll notify you via email for material changes. Continued use after changes constitutes acceptance.
